Constitutional foundations#

Mobiania is one and indivisible. The Constitution provides for separation of legislative, executive and judicial powers, the supremacy of the Basic Law and the direct application of its provisions. The principal source of law is the legislative act.

The legal system includes the Constitution, constitutional laws, laws, Imperial decrees, government decisions and orders, departmental orders and judicial decisions. Their interaction is determined by the Constitution and the individual acts. A decree cannot be credited with the power to ignore the Constitution solely because of the Emperor's practical authority.

All subjects and guests within the state's territory must observe its laws. Legislative acts and judicial decisions must be published; the Constitution links the validity of unpublished acts to this requirement.

The Emperor#

The Emperor is the sole head of the state and government. The office is hereditary and held for life; authority is acquired after coronation. The Constitution's transitional provisions recognise Miles I Prower as the legitimate head of state.

The Emperor safeguards sovereignty, territorial integrity and security; appoints and dismisses heads of executive institutions and the Supreme Judge; decides matters of subjectship, exile, honours and honorary titles; and has powers concerning defence, pardons and delegation of his functions. He governs the capital directly.

The principal titles are Emperor of Mobiania, Count of Mobotropolis and Lord Protector of Mobian foxes. The titles Count of Truro and Count of London were used historically in connection with the capitals of those periods. A territorial title cannot be mechanically inserted into documents of another period.

During vacancies the Emperor temporarily performs the duties of absent ministry heads. A secretary, adjutant or deputy within a service does not constitute a second monarch.

Six ministries#

InstitutionRussian abbreviationMobian abbreviationLeadership and responsibilities

Ministry of Foreign AffairsMIDMFAMinister of Foreign Affairs; foreign relations
Ministry of Internal AffairsMVDMIAMinister of Internal Affairs; public order and internal security
Ministry of HealthMZMOHMinister of Health; medical affairs

These institutions form the permanent basis of executive government. The Constitution permits other institutions to be established or abolished by decree. The exact distribution of responsibilities is defined by their acts; detailed departmental regulations cannot be replaced by editorial assumptions.

Melissa Prower may act as the Emperor's deputy within the ISS, on the basis of her appointment. This is the consort's service role, not independent supreme authority.

The government#

The government is the highest executive body, comprising the Chairman, General Prosecutor and ministers. In the archived Constitution the Chairman is the Emperor. The government ensures defence, security, foreign policy, legality, public order and protection of property and subjects' rights. It issues decisions and orders.

The office of Prime Minister exists in the separate HOI4 timeline and is described in its section. It cannot be added to the text of the archived Minecraft Mobian Constitution without the corresponding edition of the Basic Law.

Parliament and referendum#

In the archived Constitution, Parliament is a unicameral legislative body of 12 deputies, elected for one month. Deputies elect its Chairman. Under the transitional provisions, the first convocation was to be elected for two weeks.

A national referendum is a form of direct expression of the nation's will. When Parliament is absent, referendums decide matters within its competence. Political practice is characterised by referendums; parliamentary elections have not been held.

The HOI4 timeline provides for 120 deputies. This is a separate characteristic, not a correction to the number in the archived document.

Parliament's powers include passing laws and amendments, matters concerning the Supreme Judge and initiating abdication. Constitutional veto and reconsideration procedures appear in the archival extracts; they are not supplemented by later unconfirmed interpretations.

Judicial system#

Justice is administered by courts. The Constitution provides for constitutional, civil, administrative and criminal proceedings. The Supreme Court is the highest and supervisory instance, interprets the Constitution, considers the constitutionality of laws and explains judicial practice.

The Emperor appoints the Supreme Judge. Judges possess the independence, security of tenure and immunity provided by the Constitution. Trials are public except where the law provides otherwise; proceedings are adversarial with equality of parties and may involve juries. Extraordinary courts may be established under martial law or a state of emergency through the prescribed procedure.

The General Prosecutor and Supreme Judge are different offices. The head of the Ministry of Justice cannot automatically be called the head of the entire judicial system.

Rights and special regimes#

The Constitution establishes rights to life, honour and dignity, reputation, liberty and personal inviolability, private and family confidentiality, confidentiality of communications, education, employment and legal assistance. Freedom of speech is limited by prohibitions on slander, insults and unfounded criticism of the authorities. Political rights and general access to senior service are organised according to a patriarchal model.

The death penalty is provided as an exceptional punishment for treason and especially serious crimes, with the Emperor's approval. Article 10 also contains a special basis for extrajudicial execution in the event of an immediate threat to public and state security.

Martial law and states of emergency are introduced by decree; the relevant constitutional rights may be restricted. The specific scope, duration, mobilisation and obligations are determined by the act introducing the regime. A historical decree does not establish that the regime remains in effect in another world years later.
